Tory Lanez recently claimed that the gun involved in the incident could not be tested for DNA because it was missing. However, the state of California has responded, calling Lanez’s claim “demonstrably false.” In a declaration filed on Tuesday and reported by Meghann Cuniff, the state argued that Lanez failed to provide any “reasonably available documentary evidence” to back up his assertion.
The state’s filing points out that Lanez’s claim is contradicted by a statement from Martin Preciado, who reviewed the Los Angeles Police Department’s (LAPD) computer system. Preciado confirmed that the LAPD still holds custody of the firearm, magazine, casings, and bullet fragments that were booked as evidence. This declaration directly challenges Lanez’s claim that the evidence was “missing.”
This latest development follows a previous confirmation from Megan Thee Stallion’s attorney, Alex Spiro, who stated in October that the gun and its magazine were indeed in LAPD custody.
In a separate legal matter, Megan recently filed a lawsuit against blogger Milagro Gramz, accusing her of spreading false information about the case on social media. The two parties have agreed to go to trial on July 21st, 2025, unless a settlement is reached before then.
The state’s response to Lanez’s petition asserts that his claim of missing evidence is unfounded, saying, “…his unsupported claim that the LAPD has misplaced or lost evidence is demonstrably false.”
